Rental Law: the deputies did not reach agreements

Far from reaching an agreement in the debate on the reform of the Rental Law in commissions, three opinions were issued: one from the ruling party, which does not carry out major reforms, another from Together for Change, which proposes reducing the length of the contracts and change the way of updating, and the remaining of the Federal interblock. Now it must be debated in the venue, but it does not yet have a date.

The majority opinion corresponds to the Front of All, claimed the current norm and did not make substantial changes: maintains the three-year contract for housing for residential use, stipulates that only “annual adjustments” can be applied using an index to update rents that combines the consumer price index (IPC) and the average taxable remuneration of stable workers (RIPTE) that must be prepared and published monthly by the Central Bank of the Argentine Republic (BCRA). ); Y grants tax benefits for properties that are for rent. In addition, it is planned to introduce the National Directorate for Consumer Protection as an arbitration body in the event of conflicts between the parties.

The approach of granting a fiscal benefit to those who have rental properties is elaborated after the strong rejection that arose from the supposed tax on idle housing that the FdT wanted to implement so that the owners prefer to turn the residences over to the real estate market.

With a minority opinion Together for Change proposes return to the 2-year term in contracts, annual and semi-annual updates, as agreed by the parties and without a fixed update rate “being able to use official indices prepared or published by national, provincial or municipal bodies, or those agreed upon by the parties”.

For its part, the Federal interblock plans to return to the 2-year term in contracts; eliminate that the landlord must accept any of the guarantees presented by the tenant; that the updates will be negotiated “freely” between the parties, that increases must be staggered, that the increases have a cap so that they do not exceed inflation; the possibility of the tenant to make advance payments and the extension of temporary contracts.

The opinion of the ruling party confirmed that there was no consensus, the Frente de Todos still will not be able to send the project to the precinct since it does not have the necessary votes to approve it, therefore the position adopted by the minority blocs will be key.
